Vietnam mulls bail worth up to $8,700

Depending on its severity, suspects of a crime in Vietnam can be released on bail if they agree to pay between VND30 million (US$1,317) and VND200 million ($8,784), according to a draft circular.

The provisional document was laid out by the Ministry of Public Security, the Ministry of National Defense, the Ministry of Finance, the Supreme People’s Court, and the Supreme People’s Procuracy, governing the bail process in the Southeast Asian country.

According to the tentative circular, investigators, the procuracy, and the court will determine the amount of bail in each case.

The surety will be no less than VND30 million for violations with minimum severity and around VND50 million ($2,196) for serious cases.

Suspects of extremely serious crimes are expected to pay a maximum of VND200 million for their temporary release.

In some special circumstances, competent agencies will be allowed to suggest bail lower than the stipulated amount. 

After being released on bail, the person involved will have to comply with summonses from competent agencies, and must not escape or commit another crime, threaten or hurt witnesses in the case, or persuade the testifiers to distort the truth.

Violating any of the conditions will automatically lead to the termination of the release on bail and the money will not be refunded.

The draft circular also listed some cases in which a temporary release would not be considered for certain suspects, such as those endangering national security or committing crimes with similar severity, wanted suspects, drug addicts, masterminds of organized crime, and ex-convicts.
