Vietnamese major general’s illegally-built villa must be demolished: authorities

The government and Party committee of Lien Chieu District in the central city of Da Nang have agreed to force the owners of two illegally-built villas in the district to demolish their premises.    

>> Retired police general defies law to build villa on forest land In talking with Tuoi Tre (Youth) newspaper on January 28, a deputy chairperson of the district People’s Committee said the local Party Committee and government have met and reached a consensus that the two villas built illegally in the district must be demolished.  One of the structures is owned by the family of Major General Phan Nhu Thach, former director of the Quang Nam Province Police Department, while the other belongs to Ngo Van Quang, a businessman engaged in gold mining. Duong Thanh Thi, chairman of the district People’s Committee, said the local authorities have reported to the city government a plan to handle the two villas. Accordingly, a fine of VND40-50 million (US$1,880-2,345) will be given to Major General Thach’s family for building a villa on land that is not for construction purposes. At the same time, this villa, with three floors, must be totally demolished as it is situated on land that is to be part of the Lang Van resort complex. The district People’s Committee will issue a decision to give the above administrative penalty before February 5 and ask the villa’s owner to demolish the building within 35 days from the date of the decision.  If the villa’s owner fails to demolish the house by March 10, the district will use its forces to take down the building and the house’s owner must incur all related costs. As previously reported, Thach’s villa is located on an area of about 4,000 square meters of forest land at the foot of the Hai Van Mountain in Hiep Hoa Bac Ward, Lien Chieu District.

The huge villa, which is surrounded by a 3 meter-tall wall, is standing out among a poor residential area.

In talking with Tuoi Tre on December 9, chairman Thi said, “Mr. Thach is building a villa there. He seems to have bought the land from local residents…Under prevailing regulations, construction is not allowed to be carried out on that land. No people are granted a license for construction there.” Regarding Quang’s villa, the same fine of VND40-50 million ($1,880-2,345) will be applied for the same offense as in Major General Thach’s case, district chairman Thi said.  And similarly, the district People’s Committee will issue a decision to give the administrative penalty before February 5 and ask Quang to dismantle his house within 35 days from the date of the decision.  As in Thach’s case, if Quang fails to demolish the house, the district will use its forces to do so and Quang will have to cover the cost of the demolition, the district authorities said.
