Donning underwear in public could lead to $10 fine

Under a proposed regulation by the Ministry of Public Security, people who wear no clothes, or just underwear, in public places will be fined up to US$9.60, while people who have sex with prostitutes may be fined up to $480. The regulation is included in a draft decree on administrative penalties for violations in the fields of security, social order and safety, social evil prevention and control, fire prevention and control, and preventing and fighting domestic violence.The ministry is collecting feedback from law agencies and the public about the new decree to perfect it before submitting it to the Government for approval.Under the proposed rules, people who are nude, or only wearing underwear in public places, including offices, halls, cultural sites, and religious facilities will be given a fine from VND100,000 to VND200,000 ($9.6).The fine rate is also applied to such acts as entering sites without required tickets, using rude, obscene or uncivilized words or gestures in public places, refusing to show ID cards or other personal papers to law enforcers when required, and other acts.  Among the higher fine rates are ones that ranges between VND1 and VND2 million for such acts as illegally using others’ ID cards, erasing or correcting IDs or personal papers; and borrowing or lending personal papers including ID cards.Those who provide false information to State agencies will be fined VND500,000-1 million.$240 fine for resisting on-duty law enforcersUnder the draft law, people who resist law enforcement officers on duty or offer them money or other interest in exchange for not being punished for lawbreaking acts will be fined VND3-5 million ($240).   As for acts that illegally help individuals or organizations evade checks, control, examination or inspection by law enforcement officers or agencies, a fine of VND500,000-1 million will be applied.People who prevent or do not execute orders of control, check or inspection by competent agencies; who argue against or take action that threatens or insults law enforcers; or who incite others not to follow checks, examinations or inspections by law enforcers, will be subject to a VND2-3 million fine.Having sex with prostitutes: fines up to $480Fines between VND5-10 million ($480) will be applied for acts of having sex with sex workers or forcing others to have sex with a prostitute. Meanwhile, those who prostitute themselves will be subject to lower fine rates: VND100,000-300,000 in normal cases, VND300,000-500,000 if they serve multiple clients at a time, and VND500,000-1 million in cases where prostitution is carried out in a debauched style.In case the sex workers involved are foreigners, they will be fined VND100,000-1 million, and may be expelled from Vietnam.Fines between VND5-10 million will be applied to repeat offenders of having sex with prostitutes or in prostituting themselves, or to people who extort money from clients or sex workers.Higher fine rates, from VND15-20 million, will be given to people who commit the following acts: abusing reputation to cover up and maintain prostitution activities; threatening to use force in protecting and maintaining prostitution; brokering prostitution activities; and contributing money to prostitution operations.Much higher rates, from VND20 million to 30 million, will be imposed on people who abuse their power or positions to shield and maintain prostitution activities.
